Lawsuit Against Three Allen Police Will Move Forward
A Federal judge says a lawsuit filed against three Allen Police officers over the death of a man they were trying to arrest should be allowed to go forward.
The three officers are accused of pinning 45 year-old Edgar Vera to the ground in August 2005 as they were trying to arrest him. The officers say Vera tried to resist, and claim they began CPR on him when they realized he wasn't breathing. The judge found conflicting evidence, and says the family's lawsuit against the officers should be allowed.
Family Attorney Michael Hindman says other officers at the scene didn't see Vera resisting arrest at all. An attorney for the three Allen police officers declined comment. A district judge will have the final say on the family's civil lawsuit.
