Rockwall Couple Takes On Mortgage Company And Wins
A mortgage company's strong-arm tactics were not strong enough for a Rockwall couple who are still in their house and 130,000 dollars richer.
Like many homeowners Mark and Patricia Jones of Rockwall fell behind on their mortgage after Mark was laid off for several months. They made arrangements with their mortgage company to catch up and did. But the mortgage was transferred to a company that botched the paperwork and put the Jones in foreclosure at one point court papers say the company sent a very large intimidating man who forced his way in and began yelling and screaming for the Jones's to leave. They sued, won and Attorney Jack Peacock Junior says an appeals court has upheld their judgment of nearly 130,000 dollars.
An attorney for the EMC Mortgage Corporation declined comment.
